The U.S. Supreme Court unanimously ruled that members of a majority group claiming workplace discrimination do not need to meet a heightened evidentiary standard to establish their discrimination claims, resolving a federal circuit court split on “reverse discrimination” claims and sending the case back to the trial court. In 2004, the Ohio Department of Youth Services hired Marlean Ames — a heterosexual woman — as an executive secretary. The agency eventually promoted her to program administrator, and in 2019, she applied for a newly created management position within the agency. A few days after her interview, however, her supervisors demoted her from program administrator to the secretarial role she had when she first joined the agency, which resulted in a significant pay cut. The agency hired a gay man to fill the program administrator position, and later, hired a lesbian woman to fill the management position, for which Ames had applied. Ames sued…
Sideswipe accidents may not seem as dramatic as head-on collisions or multi-car pileups, but don’t be fooled by the damage you only see on the surface. These types of crashes carry their own risks and can lead to serious damage and injuries, especially when they happen at high speeds or with large vehicles. Whether you’re merging on a highway or navigating tight city lanes, the danger of a sideswipe collision can escalate quickly. Understanding what causes these crashes and the damage they can do helps drivers stay alert and make safer choices on the road. What Is a Sideswipe Accident? A sideswipe is a type of car accident where the side of one vehicle strikes the side of another. These collisions often happen when the two are traveling in the same direction, but they can also happen between vehicles going in opposite directions. The impact can range from minor to severe, depending on how fast the cars were going and whether…

WASHINGTON, D.C. – Areson has issued a recall of its Rolanstar 6-drawer dressers sold exclusively on Amazon.com, following a warning from the U.S. Consumer Product Safety Commission (CPSC) over serious tip-over and entrapment risks that could lead to injury or death, particularly among children. According to the CPSC, the dressers fail to meet multiple safety requirements mandated under the STURDY Act, a federal regulation designed to reduce the dangers associated with unstable clothing storage units. Testing revealed that the dressers can tip over when less than 60 pounds of force is applied to the front, well below the safety threshold. The units also do not meet federal labeling requirements meant to alert consumers to potential hazards. WASHINGTON, D.C. – The U.S. Consumer Product Safety Commission (CPSC) is warning consumers to stop using Aiho-brand dressers immediately due to serious safety concerns. The dressers pose a risk of tip-over and entrapment hazards, particularly to children, if not properly anchored to a wall. According to the CPSC, the affected units fail to meet mandatory stability and labeling requirements outlined under the STURDY Act and federal safety standards for clothing storage units. These regulations were enacted to reduce the risk of injury or death caused by furniture tipping over — an issue linked to an estimated 10 fatalities and over 5,000 injuries in the U.S. each year. The victim has been identified as Nazly Rodriguez-Munoz of Des Plaines. Police say officers responded to a crash near Algonquin Road and Leslie Lane just before midnight. Upon arrival, they found Rodriguez-Munoz in the front passenger seat of a Toyota Prius, suffering from a severe leg injury. Officers applied a tourniquet before Des Plaines Fire Department paramedics transported her to a nearby hospital, where she later died from her injuries. Preliminary findings indicate the Prius, driven by 28-year-old Giovanna Rodriguez-Fuentes of Des Plaines, was traveling eastbound on Algonquin Road when it collided with the rear of a Volvo semi-truck. Rodriguez-Fuentes told police the semi was parked on the south side of the road without its lights on. The truck driver, however, reported moving eastbound at a slow speed…

At the same time, the semi-truck, operated by a 62-year-old Yuba City man, was traveling southbound and attempting to turn left onto Hartnell Road. During the turn, the semi-truck crossed into the northbound lanes, and the right side of the trailer struck the front of the pickup. DOÑA ANA COUNTY, N.M. – Two people were hospitalized with serious injuries following a rollover crash Sunday morning on Interstate 10 East. The incident occurred between Anthony and Vado. Authorities say a pickup truck rolled over for reasons that remain unknown. Both the male driver and female passenger sustained serious injuries and were transported to a nearby hospital for treatment. No other vehicles were involved in the crash. Vehicles need to be checked for defects in rollover crashes There is a misbelief that the driver alone is to blame for injuries sustained in rollover crashes, especially when only one vehicle is involved. However, this is not always true. While drivers should be cautious to prevent rollovers, manufacturers also play an important role in keeping occupants safe during such accidents. Manufacturers are well aware of the frequency and danger of rollover accidents. Since they know this, they must design a vehicle that can withstand the impact…

PARMA, Mich. – A crash involving three semi-trucks and a pickup truck on I-94 near Parma Road on Friday morning left two people injured and one driver temporarily trapped inside a vehicle. According to the Jackson County Sheriff’s Office, the collision occurred when a semi-truck driver failed to slow for traffic and struck two other semis and a pickup. Emergency crews had to extricate the driver of the pickup from the wreckage. Two individuals were transported to a nearby hospital, one initially reported in critical condition. That driver’s condition has since been upgraded to serious. The injured deserve answers, justice, and compensation Due to their large size and massive weight, semi-trucks need a greater distance to stop safely and avoid a collision with the vehicle in front of them. Large commercial trucks that follow too close or speed in reduced or stopped traffic areas are playing with danger. The Federal Motor Carrier Safety Administration (FMCSA)…
NICREW has issued a recall for its 15-inch Submersible RGB LED Lights with remote controls due to a serious safety risk involving the product’s lithium coin battery. The affected lights were sold through Amazon by seller Nicrew CREW. According to federal regulators, the remote control’s battery compartment can be easily opened, allowing children to access and potentially swallow the coin battery inside. The product also lacks the required warning labels, violating federal safety standards for consumer goods that use button cell or coin batteries. Swallowing coin batteries can result in severe internal injuries, including chemical burns, and may be fatal. Ed. note: Welcome to our daily feature, Quote of the Day. Our firm is now known more broadly than it’s ever been known in the legal community and even beyond the legal community. We have had clients and potential clients say to us sometimes, on a confidential basis, that they are particularly looking at us for matters because of how we’ve responded to what they at least personally agree with as attacks on the rule of law. — Laurie Carr Mims, managing partner of Keker Van Nest & Peters, in comments given to Law.com Pro Mid-Market, on the firm’s response following John Keker’s “60 Minutes” interview condemning the Trump administration’s actions against law firms. “We [were] willing to take on the risk. We’ve had a history of taking on the government when we see unconstitutional acts. We did so in the first Trump administration, we did so in the Biden administration,” Mims said. “We stand up against…
Kaufman Dolowich’s Christopher Nucifora, Chair of KD’s Commercial Litigation Practice Group and Co-Managing Partner of the firm’s New Jersey office, was featured in a Q & A in Am Law Litigation Daily article, where he reflected on how lessons learned from his early wrestling days have influenced his legal career. Mr. Nucifora wrestled during his youth up until his second year at Rutgers University, when he stopped to focus on his studies with intentions of getting into law school. More than two decades later, he is reflective on those years. He notes in the article, “I made the choice to concentrate on getting into law school rather than wrestling, which financially was a much better decision. But emotionally, it’s still something that sticks with me.” In fact, it’s the lessons that he picked up in wrestling that he still applies today in life as a litigator and outside counsel for clients. “I would say the hard work,…
